Repair Terms of Service

These Repair Terms of Service (the “Agreement”) apply to all repair services (the “Services”) provided by Kemo Wireless (“Company”). By using our Services and Website, you agree to these terms.
Mandatory Arbitration and Waiver: This Agreement includes a mandatory arbitration provision for resolving disputes and a waiver of jury trial and class action rights. If you disagree with these terms, do not use the Services.
Definitions:
“We,” “Us,” and “Our” refer to the Company and its affiliates, agents, employees, and franchise owners.
“You” and “Your” refer to the individual or entity using the Services.
“Service Authorization & Estimate” is the receipt detailing the Services and estimated costs.
“Device” refers to the eligible device identified on the Service Authorization & Estimate.
“Website” means https://www.kemowireless.com/.
Privacy Policy: By using the Services, you consent to our collection, use, and disclosure of your information as described in our Privacy Policy, available on our Website. We collect information through automatic means (e.g., cookies, web beacons) and may require personal information to provide Services. We are not responsible for unauthorized access to your data and recommend changing passwords if you suspect any security breaches.
Representations: You represent that you are the owner or authorized user of the Device and that any information provided is not confidential or proprietary.
Authorizations: You authorize us to perform the Services described in the Service Authorization & Estimate. Changes to your Device may be permanent and irreversible.
Scope of Services: Services include repair and technical support for your Device. We may use new, rebuilt, reconditioned, or refurbished parts. Services may void any manufacturer’s warranty.
Service Availability: Services are available during store hours. We may cancel or refuse Services based on location or other factors.
Eligibility: Eligible devices include phones, laptops, tablets, and more. Eligibility is determined by a visual and physical inspection.
Back Up: You are responsible for backing up your data. We are not responsible for data loss. We may refuse Service if appropriate back-up measures are not taken.
Abandonment: If you fail to pick up your Device within 60 days after Service completion, it will be considered abandoned and become our property.
Replacement Devices: If your Device is lost, stolen, or damaged while in our possession, we will repair or replace it with a similar device.
Limited Warranty: Repairs and parts are warranted for one year. This Limited Warranty does not cover damage from moisture, misuse, or unauthorized modifications.
Disclaimer and Limitation of Liability: Services are provided "as is" and "as available." We disclaim all warranties except those explicitly stated. Our liability is limited to the fees paid for the Services or $100, whichever is greater.
Modifications: We may modify this Agreement at any time. Continued use of the Services indicates acceptance of the changes.
Severability & Waiver: If any term is found invalid, it will be modified to be enforceable or severed if necessary. Failure to enforce a term is not a waiver of our rights.
Arbitration Agreement: Disputes will be resolved through binding arbitration or small claims court. Class action and jury trial waivers apply.
